This is a public records request for the aggregate data collected by University of North Carolina about sexual violence incidents since January 1, 2007 or as far back in time as the data is collected. I ask that the data be provided in delimited electronic format, including but not limited to the following fields: nature, date, time and general location of the sexual violence incident.

This request is based on section E-3 of the U.S. Department of Education’s Office of Civil Rights’ document titled “Questions and Answers on Title IX and Sexual Violence” — a document that the Department of Education determined is a “significant guidance document” under the Office of Management and Budget’s Final Bulletin for Agency Good Guidance Practices, 72 Fed. Reg. 3432 (Jan. 25, 2007) and can be found here — which states the following:

“In order to identify patterns or systemic problems related to sexual violence, a school should collect aggregate data about sexual violence incidents from non-professional counselors or advocates in their on-campus sexual assault centers, women’s centers, or health centers. Such individuals should report only general information about incidents of sexual violence such as the nature, date, time, and general location of the incident and should take care to avoid reporting personally identifiable information about a student. Non-professional counselors and advocates should consult with students regarding what information needs to be withheld to protect their identity.”

If there are any fees for searching or copying these records, please inform me if the cost will exceed $20. However, I would also like to request a waiver of all fees in that the disclosure of the requested information fits squarely in the public interest and will contribute significantly to the public’s understanding of sexual violence incidences on college campus. I seek this information for news-gathering purposes as reporter for the Oregon Daily Emerald newspaper.

In any event if you determine that any of the information is exempt and will not be disclosed, please provide me with a signed notification that cites the specific legal authorities which you believes justifies that exemption.

The documents and the information that follows are being provided to you in accordance with the North Carolina Public Records Act. The attached document provides information on cases for the 2007-08 through 2014-15 academic years under the previous and current policies. Please note, the Honor Court heard student cases involving allegations of sexual assault or sexual misconduct until the policy changed in January 2012. Under the 2012 policy, a Student Grievance Committee comprised of faculty, staff and students heard these cases under a more formal hearing process. The University implemented its current policy on August 28, 2014. Under the current policy, the Equal Opportunity and Compliance Office is the office responsible for addressing reports of sexual assault and related forms of misconduct at UNC-Chapel Hill. The Equal Opportunity and Compliance Office prepares an annual report that examines actions taken in support of the University’s Policy on Prohibited Discrimination, Harassment and Related misconduct, including Sexual and Gender-Based Harassment, Sexual Violence, Interpersonal Violence, and Stalking. This Annual Report, which is available at, covers activities initiated or completed during the period from August 2014-August 2015. This request has been fully processed and is closed.
