RE: North Carolina Public Records Request: UNC-CH Title V Facilities


Dear Public Records Officer,
The Center for Biological Diversity (“Center”) is a non-profit organization that works to secure a
future for all species hovering on the brink of extinction through science, law, and creative
media, and to fulfill the continuing educational goals of its membership and the general public in
the process. The Center makes this request pursuant to North Carolina’s Public Records Act,
N.C. G.S. § 132-1 to § 132-9, which requires state agencies to promptly respond to requests for
public records.
REQUESTED RECORDS
The Center is requesting the following records from the University of North Carolina at Chapel
Hill (“UNC”) regarding UNC’s facilities that are covered by UNC’s Title V permit
(“Facilities”):
1. For the fire pump identified as ES-FP-3 - 225 Hp diesel-fueled fire pump at the Davis
Library:
a. All Dispersion Modeling Analyses, generated in connection with compliance with
the 1-hour NO2 National Ambient Air Quality Standards (“NAAQS”), and
submitted to state regulators prior to May 1, 2017;
b. All Dispersion Modeling Reports generated in connection with compliance with
the 1-hour NO2 NAAQS, and submitted to state regulators prior to May 1, 2017;
and
c. All operating logs, irrespective of the date the logs were created.
2. For the fire pump identified as ES-FP-3 - 110 Hp diesel-fired fire pump at the Davis
Library:
a. All Dispersion Modeling Analyses regarding compliance with the 1-hour NO2
NAAQS, and submitted to state regulators prior to May 1, 2017;
b. All Dispersion Modeling Reports regarding compliance with the 1-hour NO2
NAAQS, and submitted to state regulators prior to May 1, 2017; and
c. All operating logs, irrespective of the date the logs were created.

3. From July 1, 2008 to the date UNC conducts this search, for Boilers 6,7,8,9, and 10
(excluding raw data):
a. All Continuous Emissions Monitoring Systems (“CEMS”) hourly values data;
b. All Continuous Opacity Monitoring Systems (“COMS”) six-minute values data;
c. All stack temperature data; and
d. All exit velocity data.
4. The air modeling showing weekly readiness testing for emergency generators and/or fire
pumps concurrent with:
a. Simultaneous operation of the two blackstart 2,000-kw generators, and submitted
to the state between January 1, 2012 and April 1, 2017; and
b. Simultaneous readiness testing of fire pumps and/or emergency generators, and
submitted to the state between January 1, 2012 and April 1, 2017.
5. The records generated in connection with the Title V Compliance Report:
a. All attachments to the Title V Compliance Report covering the time period
spanning from January 1, 2014 to December 31, 2014, and filed with the North
Carolina Division of Air Quality (“NCDAQ”) in February 2015;
b. All records mentioning, including, and/or referencing enforcement action taken in
response to the violation/s disclosed in the Title V Compliance Report covering
the time period spanning from January 1, 2014 to December 31, 2014, and filed
with NCDAQ in February 2015;
c. From January 1, 2013 to December 31, 2013, and for July 1, 2017 to December
31, 2017, all semi-annual monitoring reports related to the Facilities’ Title V
compliance. (Note: The Center previously requested these items in our November
28, 2017 Open Records Act request, and while UNC provided such for 2012 and
2014, UNC excluded the relevant items from 2013 out of its release); and
d. All quarterly Title V excess emission reports for the Facilites.
6. For Boiler 6 (ES-001) and Boiler 7 (ES-002):
a. From January 1, 2013 to the date UNC conducts this search:
i. All summary fuel record reports, submitted pursuant to 15A NCAC
2Q.0508(f); and
b. From January 1, 2015 to the date UNC conducts this search:
i. All records and/or data mentioning, including, and/or referencing sorbent
purchases made; and
ii. All sorbent injection rate logs.
c. All records mentioning, including, and/or referencing the 3-hour block average
sorbent injection rates;
d. All permit modification applications submitted to NCDAQ for the purpose of
incorporating the minimum sorbent injection rate into the air quality permit;
e. All administrative amendments to the air quality permit incorporating the
minimum sorbent injection rate into the air quality permit;
f. All logbooks kept pursuant to 15A NCAC 2D.0515 for inspection and
maintenance of the coal handling, conveying, crushing and storage system;

g. All records and/or data mentioning, including and/or referencing the semiannual
monitoring and recordkeeping Summary Reports for the coal handling,
conveying, crushing and storage system, as required by 15A NCAC 2Q.0508(f);
h. All logbooks kept pursuant to 15A NCAC 2Q.0508(f) and 15A NCAC 2D.0524
for testing and monitoring visible emissions/opacity from the coal handling,
conveying, crushing and storage system;
i. All logbooks kept pursuant to 15A NCAC 2Q.0508(f) and 15A NCAC 2D.0521
for inspection, monitoring and maintenance of visible emissions from the ash
handling, storage and loading system;
j. All records and/or data mentioning, including and/or referencing the semiannual
monitoring and recordkeeping Summary Reports for the ash handling, storage and
loading system, as required by 15A NCAC 2Q.0508(f);
k. All records and/or data kept pursuant to 15A NCAC 2D.0501(c) mentioning,
including and/or referencing the continuous emissions monitoring for hourly SO2
emissions listed in pounds-per-hour and pounds-per-mmbtu; and
l. All records and/or data kept pursuant to 15A NCAC 2D.0501(c) mentioning,
including and/or referencing the continuous emissions monitoring for 24-hour
block SO2 emissions values listed in pounds-per-hour and pounds-per-mmbtu.
7. All records of input and output files and/or any reports for:
a. The air dispersion modeling for a 300-kilowatt (kw) generator which found a
maximum impact of 187.16 micrograms per cubic meter (ug/m3) of nitrogen
dioxide (NO2); and
b. The air dispersion modeling analysis required to be submitted to the State of
North Carolina to demonstrate compliance with the annual NO2 NAAQS, and due
within 120 days of the issuance of Air Quality Permit No. 03069T30, pursuant to
the permit and 15A NCAC 2D.0501(c).
8. All records and/or data mentioning, including, and/or referencing:
a. Case-by-Case Maximum Achievable Control Technology (“MACT”) for boilers
and process heaters, including relevant sorbent injection rates, for initial
compliance testing and annual performance testing;
b. The Toxic Air Pollutants testing results for any emission units listed under the
Title V permit;
c. The 2017 Compliance Certification for Toxic Air Pollutants for any emission
units listed under the Title V permit;
d. The boiler and process heater Semiannual Summary Reports submitted to
NCDAQ pursuant to 15A NCAC 2Q.0508(f);
e. Setting the sorbent injection rate in accordance with Section 2.1.A.4.g. of the Title
V permit;
f. The five (5) initial acute toxicity tests required to be submitted to North
Carolina’s Division of Water Quality pursuant to UNC’s National Pollutant
Discharge Elimination System (“NPDES”) Permit No. NC0025305, as described
in Part I, Page 2 of 12 of said permit; and
g. From April 16, 2012 to the date UNC conducts this search, all records and/or data
mentioning, including, and/or referencing sorbent injection rates for boilers and

process heaters, submitted to the State of North Carolina. (Note: this is a separate
request from Item #8(a) asking for all sorbent injection rates documented by UNC
subsequent to initial compliance testing).
9. For ES-1, ES-2, ES-3, ES-010A:
a. All log books kept for monthly external visual inspection of each bagfilter, two
coal silos, the crusher building, and four coal bunkers;
b. All log books kept for annual internal inspection of each bagfilter, two coal silos,
the crusher building, and four coal bunkers.
10. For ES-030(ash storage silo with dry loadout), and ES-030A (wet ash loadout system):
a. All log books kept for monthly external visual inspection of each bagfilter, daily
ash loadout system, V.E. observation and Method 9 V.E; and
b. All log books kept for annual internal inspection of each bagfilter;
11. For ES-Gen-13:
a. All manufacturer operation and maintenance (“O/M”) instructions; and
b. All records of O/M kept.
12. From January 1, 2013 to the date UNC conducts this search:
a. All permit deviation reports submitted pursuant to 15A NCAC 2D.0535(f) and
15A NCAC 2Q.0508(f)(2); and
b. All excess emission reports submitted to NCDAQ pursuant to 15A NCAC
2D.0535(f).
13. All summary reports regarding visibility monitoring for CAM, submitted pursuant to 15A
NCAC 2Q.0508(f).
14. All MACT startup, shutdown and malfunction plans, including, but not limited to the one
for Diesel Generator ES-007.
15. All annual inspection and maintenance (“I/M”) records maintained onsite for Boiler 9
(ES-004), Boiler 10 (ES-004), and ES-SB-6, from January 1, 2014 up to the date of this
search.
16. All logbooks kept in compliance with 15A NCAC 2D.1109 generated in connection with
the burner inspection and maintenance pursuant to 15A NCAC 2Q.0508(f).
17. On or about on September 9, 2013, all Notices of Compliance Status filed with the State
of North Carolina for the Facilities pursuant to 15A NCAC 2Q.0508(f) and 40 CFR
63.9(h)(2)(ii).
For this request, the term “records” refers to, but is not limited to, all documents and/or all other
responsive records, in draft or final form.

This request covers any non-identical duplicates of records that by reason of notation,
attachment, or other alteration or supplement include any information not in the original record.
The Center is willing to receive responsive records on a rolling basis.
FEE WAIVER REQUEST
The Center requests a waiver of all fees because the disclosure of the requested information is in
the public interest and will contribute significantly to public understanding of the air quality
impacts of UNC’s overall operations on the surrounding community. The CAA permit for the
coal plant is actually a CAA/Title V permit for a multiple facilities on UNC campus, including
the Mannind Drive Steam Plant and dozens of emergency generators. The total cumulative
emissions from these facilities are capped at a certain level under the permit, which means that
the public cannot examine whether emissions from the coal plant are violating the terms of the
permit without first examining the emissions from all of the relevant facilities that are regulated
under the permit. The Center will use the requested records help educate the public on the
significance of North Carolina state regulators allowing UNC to have a permit that allows
pollution in excess of the limits set by the CAA. The Center has used past publicly available
information to inform the public about pollution’s adverse effects on climate and air quality.
The Center is a non-profit organization that informs, educates, and counsels the public regarding
environmental issues, policies, and laws relating to environmental issues. The Center has been
substantially involved in the activities of numerous government agencies for over 25 years, and
has consistently displayed its ability to disseminate information granted to it through public
records requests.
In consistently granting the Center’s fee-waivers, agencies have recognized: (1) that the
information requested by the Center contributes significantly to the public’s understanding of the
government’s operations or activities; (2) that the information enhances the public’s
understanding to a greater degree than currently exists; (3) that the Center possesses the expertise
to explain the requested information to the public; (4) that the Center possesses the ability to
disseminate the requested information to the general public; (5) and that the news media
recognizes the Center as an established expert in the field of imperiled species, biodiversity, and
impacts on protected species. The Center’s track record of active participation in oversight of
governmental activities and decision making, and its consistent contribution to the public’s
understanding of those activities as compared to the level of public understanding prior to
disclosure are well established.
The Center intends to use the records requested here similarly. The Center’s work appears in
more than 2,500 news stories online and in print, radio and TV per month, including regular
reporting in such important outlets as The New York Times, Washington Post, The Guardian, and
Los Angeles Times. Many media outlets have reported on the effects of pollution on
environmental health, utilizing information obtained by the Center from federal and state
agencies. In 2017, more than 2.7 million people visited the Center’s extensive website, and
viewed pages a total of 5.7 million times. The Center sends out more than 277 email newsletters
and action alerts per year to more than 1.6 million members and supporters. Three times a year,

the Center sends printed newsletters to more than 63,000 members. More than 304,800 people
have “liked” the Center on Facebook, and there are regular postings regarding environmental
protection. The Center also regularly tweets to more than 57,900 followers on Twitter. The
Center intends to use any or all of these far-reaching media outlets to share with the public
information obtained as a result of this request. Disclosure of the requested information is in the
public interest as it will contribute significantly to providing insight into the adverse effects of
pollution generated by the UNC campus. The information is not being sought for commercial
purposes; thus, the Center qualifies for a fee waiver.

We hope that UNC will immediately grant this fee waiver request and begin to search and
disclose the requested records without any unnecessary delays. If access to the records will take
